What does the EU AI Act require of voice AI vendors?
The EU AI Act applies a tiered, risk-based framework. Voice AI sits primarily in three layers of the Act: the transparency layer (Article 50), the high-risk classification layer (Article 6 plus Annex III), and the GPAI layer for the underlying speech and language models. The Article 50 transparency obligation
Article 50 of Regulation (EU) 2024/1689 requires that providers ensure AI systems intended to interact directly with natural persons are designed and developed in such a way that the persons concerned are informed they are interacting with an AI system, unless this is obvious from the context. For voice agents, "obvious from the context" is rarely met - synthetic voices are increasingly hard to distinguish from human ones, especially on telephony. The practical implication: a compliant voice AI must disclose its AI nature within the opening seconds of every interaction, in a form a reasonable caller can understand.
Article 6 high-risk classification
Some voice AI deployments are classified as high-risk under Article 6 of the AI Act. Annex III lists the relevant use cases, including AI used in employment decisions (e.g. voice-based recruitment screening), access to essential private and public services (e.g. creditworthiness over the phone), and certain law-enforcement functions. High-risk classification triggers a substantial obligation set: risk management systems, data governance, technical documentation, logging, human oversight, accuracy and cybersecurity requirements, and a conformity assessment before placing on the market.
GPAI obligations on the underlying models
Voice AI vendors typically depend on third-party large language and speech models. Under Chapter V of the AI Act, providers of General-Purpose AI (GPAI) models must publish technical documentation, a copyright policy, and (for models with systemic risk) cybersecurity protections. No platform self-certifies as "EU AI Act compliant" today - Article 50 enforcement only begins in August 2026 and conformity assessment bodies are still being designated by Member States. What buyers can assess now is alignment: which vendors already implement Article 50-style disclosures, hold robust EU data residency, publish transparency documentation, and operate from EU legal entities under EU supervisory authorities.

When does the EU AI Act enforcement begin?

How are voice AI systems classified under Article 6?

Most commercial voice AI use cases - reception, scheduling, order intake, customer support, outbound qualification - sit in the limited-risk tier. Their main obligation is Article 50 disclosure. GPAI model obligations for voice AI vendors
Most voice AI products today are thin orchestration layers over General-Purpose AI models from a small number of foundation labs. Chapter V of the Regulation imposes obligations on those GPAI providers: technical documentation, a copyright compliance policy, summary of training content, and (for systemic-risk models) model evaluations, incident reporting and cybersecurity measures. The European AI Office is the supervisory body for these GPAI rules.
For a voice AI buyer, the practical question is documentation traceability. Your vendor should be able to tell you which GPAI providers sit behind their pipeline, which versions of those models are in production, and whether those providers have submitted the documentation required under Article 53. Vendors that cannot answer those three questions in writing are a procurement risk for any EU mid-market or enterprise deployment after August 2026.
Penalties and enforcement bodies
Article 99 sets the penalty structure. Non-compliance with the prohibited practices in Article 5 carries fines up to EUR 35 million or 7% of worldwide annual turnover, whichever is higher. Non-compliance with other operator obligations (including Article 50 transparency and high-risk obligations) carries fines up to EUR 15 million or 3% of turnover. Supply of incorrect, incomplete or misleading information to authorities carries up to EUR 7.5 million or 1% of turnover. The European Data Protection Board coordinates with national supervisory authorities on overlapping GDPR and AI Act enforcement.
Enforcement is split between Member State market surveillance authorities (each country designates its own competent authority) and the European AI Office for GPAI models. For cross-border voice AI deployments, the lead authority will typically be in the Member State of the deployer's main establishment, not the vendor's.
