The answer changes at every border, because each of the 27 member states transposed the ePrivacy automated-call rule into its own law. The decisive question per country is whether that rule covers businesses (legal persons) or only consumers. Where it protects consumers only, a disclosed AI-voice B2B cold call can run on an opt-out basis; where it also covers businesses, an automated cold call needs prior consent.
